1. Agreement To These Terms
These terms of service form an agreement between you and SUSHI SECRETS INC., an omakase counter operator at 2110 Shattuck Ave, Berkeley, 94704-1209, United States. By making a reservation, attending the counter, booking a class, arranging a buyout, or using our website, you agree to be bound by these terms. If you do not agree, please do not proceed with a booking.
If you book on behalf of a group, you confirm that you have authority to accept these terms for every guest in that group. By sending us a message or completing a booking, you confirm that you are at least eighteen years of age and legally able to enter into this agreement.
These terms should be read together with our privacy policy, which explains how we handle personal information, and with any booking confirmation we send you, which may add specific details such as a deposit requirement, a menu note, or a cancellation window for a particular evening. Where a booking confirmation conflicts with these general terms, the booking confirmation controls for that booking.
We may provide these terms in more than one language for convenience. If a translated version ever conflicts with the English version, the English version controls.
2. Our Services
SUSHI SECRETS INC. provides an intimate omakase tasting counter service at 2110 Shattuck Ave, Berkeley, 94704-1209, United States. Our services include a seasonal tasting of approximately ten courses, a shorter seasonal nigiri flight, reserved bar seating, a sake pairing program, private counter buyouts, and chef table classes. Each service is subject to the availability of seats, the season, and the market.
We serve a single seating counter and we take reservations only. Menu composition changes with the market and the season and is set by the chef. Images, descriptions, and course counts on our website are illustrative and may change without notice as ingredients change.
We may add, pause, or retire a service as the business changes. When we retire a service, we will honor confirmed bookings for that service wherever we reasonably can. We may also limit the number of seats a single party can hold on a given evening so that the counter stays available to a range of guests.
Our services are offered for personal dining and small private gatherings. Unless we agree in writing, they are not offered for resale, for commercial catering, or for events that require the counter to operate outside its normal conditions. Any use of our name or branding in connection with a third party event requires our written permission.
3. Reservations
Reservations are required for every service at the counter. A reservation request is not a confirmed booking until we confirm it by email or telephone. We may ask for a contact name, a telephone number, an email address, the requested service, the date and time, the party size, and any information the kitchen needs to serve you safely.
We hold the number of seats you reserve for the seating you choose. Seats are not transferable to another party without our agreement, and reselling a reservation is not permitted. If we believe a reservation was made for resale or in bad faith, we may cancel it and release the seats.
We confirm reservations in the order they arrive. For high demand evenings we may keep a waiting list and contact the next guest if a seat is released. A place on the waiting list is not a confirmed seat and creates no obligation on either side until we confirm in writing.
Please give us accurate contact details. If we cannot reach you to confirm a booking, we may release the seats after a reasonable attempt. If your plans change, tell us early so that we can return the seats to the list and serve another guest.
4. Deposits And Payment
We may require a deposit to hold a seat, particularly for peak evenings, large parties, classes, and private buyouts. Any deposit requirement will be communicated clearly before your booking is confirmed. The deposit is applied to the final bill for the service you receive.
Payment for the balance is due at the end of service unless we have agreed to different arrangements in advance. We accept the payment methods shown to you at booking or at the counter. Prices are stated in United States dollars and may change between bookings to reflect market costs and seasonality. Applicable taxes and service charges are added where required.
A deposit, where required, is applied to the final bill and is not an additional charge. If you pay a deposit and then do not attend inside the cancellation window, the deposit may be retained as described in the cancellation section. We will always tell you in advance when a deposit is required and how it will be treated.

5. Cancellation And Changes
Because our menu is bought fresh to each seat, cancellation terms protect the kitchen as well as the guest. A cancellation made more than forty eight hours before the start of your seating is generally free of charge. A cancellation made inside that window may forfeit a deposit, and a no show may be charged the full price of the reserved seats.
If you need to reduce your party size or move your date, contact us as early as possible and we will do what the calendar and the buying sheet allow. We may be able to move a booking to another evening of the same menu. Changes are confirmed only when we respond in writing.
We may cancel or reschedule a seating when necessary, such as for illness, a supply problem, or a safety concern. If we cancel and cannot offer a reasonable alternative, we will refund any deposit paid for that service.
Repeated late cancellations or no shows may lead us to require a larger deposit for future bookings, or to decline future bookings, because the seats we hold for one guest cannot easily be returned to the market once the buying is done.
6. Arrival And Punctuality
The counter opens together and courses are timed to the room. Please arrive within the first ten minutes of your seating. Guests who arrive late may join the menu at the course then being served, and we may not be able to serve courses that have already passed. We cannot extend a seating beyond its reserved window for a late arrival, because the next service depends on the room being reset on time.
If you are delayed, call us at +17858189183 as soon as you can and we will tell you what is possible. The counter is small, so a late arrival also affects the guests beside you.
If you must leave early, please tell us at the start of service so that the kitchen can pace your remaining courses. We will do our best to serve you fully within the time you have, but we cannot delay the room for one guest once the next course is ready.
8. Allergies And Safety
Food allergies can be serious. Please disclose any allergy when you book and remind the staff when you arrive. We take reasonable steps to avoid cross contact, but the counter is a shared space and we cannot promise a completely allergen free environment. If you carry emergency medication, please bring it with you.
If you experience a medical emergency at the counter, staff will call for help and provide reasonable assistance. You are responsible for informing us of any condition that affects how we should serve you, including a condition that makes raw or cured fish unsuitable.
Some of our dishes contain raw or cured fish, shellfish, soy, sesame, gluten, and other common allergens. A guest who is pregnant, immunocompromised, or otherwise advised by a medical professional to avoid raw food should consider whether the menu is suitable before booking. If in doubt, contact us and we will describe the menu honestly.
9. Alcohol And Sake Service
Where we serve sake or other alcohol, we do so only to guests of legal drinking age. We may ask for valid identification and we may decline to serve anyone who cannot show it. We reserve the right to refuse service to any guest who appears intoxicated or who places other guests or staff at risk.
You may not bring your own alcohol to the counter unless we have agreed to it in writing in advance. The sake pairing program is offered as a curated set and cannot be resold or transferred.
We may decline to serve alcohol to a guest who does not show acceptable identification, who appears intoxicated, or who is disruptive. We may also stop serving alcohol to the room at any point when we believe it is the right thing to do. Any decision to refuse alcohol service is not a basis for a refund, and we will always offer a non alcoholic alternative where one is available.
10. Chef Table Classes
Chef table classes seat a small number of guests and are booked by the seat. Payment is generally required in advance to hold a place. Because class ingredients are prepared to the booked seats, a class cancellation made inside the cancellation window may forfeit the fee. If you cannot attend, you may ask whether another guest may take your seat, subject to our agreement.
Classes involve the use of sharp tools and a working kitchen. You agree to follow all safety instructions given by staff. We may remove a participant who does not follow safety instructions or who puts others at risk.
Class content is provided for personal education and enjoyment. Techniques shown in a class are not a certification, and we accept no responsibility for food prepared at home by a participant after the class.
11. Private Counter Buyouts
A private counter buyout reserves the entire room for your group. Buyouts require advance planning, a firm guest count about one week before service, and a final confirmation two days before service. A deposit is typically required, and the balance is due after the event unless we agree otherwise.
A buyout may have a minimum spend and a set menu chosen in advance. Cancellation terms for buyouts are stated in the booking confirmation and may differ from the standard counter terms because the whole room is held and the buying is dedicated to your group.
The guest count you confirm drives the buying and the pricing, so a late reduction in numbers may not reduce the total charge, and an increase may not be possible on short notice. We will always tell you clearly how a change will affect the final bill before we apply it.
12. Guest Conduct
We want the room to stay calm and pleasant for everyone at the counter. We ask guests to keep voices reasonable, to keep phones face down unless photographing a plate, and to treat staff and other guests with courtesy. Abusive, threatening, or disruptive behavior is not permitted and may result in removal from the premises without refund.
We may refuse service or ask a guest to leave if their conduct endangers others, damages property, or repeatedly disrupts the evening. We are not obligated to provide any refund in those circumstances.
Guests are responsible for any damage they cause to the counter, the case, the fixtures, or any property of SUSHI SECRETS INC. Where damage results from careless or intentional conduct, we may seek recovery of the reasonable cost of repair or replacement.
13. Photography And Recording
You are welcome to photograph the food and the room for personal use. Please do not photograph other guests in a way that identifies them without their consent, and please do not use a flash or a tripod that interferes with service. Commercial filming or photography on the premises requires our written permission in advance.
We may take photographs or video of the counter and its dishes for our own promotional use. We will not use an identifiable image of a guest for promotion without consent. If you would prefer not to appear in any footage, tell a staff member when you arrive.
14. Limitation Of Liability
To the fullest extent allowed by law, SUSHI SECRETS INC. is not liable for indirect, incidental, special, or consequential damages arising from our services or your visit. Our total liability for any claim relating to a service is limited to the amount you paid for that service.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence where such limits are not permitted. Some jurisdictions do not allow certain exclusions, so part of this section may not apply to you.
You are responsible for your own personal property while at the counter. Please keep bags and phones secure and within sight. We are not responsible for the loss of personal property left unattended on the premises, though we will help you look for a misplaced item and hold found items for a reasonable period.
15. Indemnification
You agree to indemnify and hold harmless SUSHI SECRETS INC., its staff, and its suppliers from claims, damages, and reasonable costs arising from your breach of these terms, your misuse of our services, or your violation of the rights of a third party. This obligation survives the end of your relationship with us.
16. Website Use And Intellectual Property
All content on our website, including text, layout, graphics, and the counter cross section design, is owned by SUSHI SECRETS INC. or used with permission and is protected by intellectual property law. You may view and print pages for personal, non commercial use. You may not copy, republish, or redistribute our content for commercial purposes without our written permission.
You agree not to misuse our website, including by attempting to gain unauthorized access, by introducing harmful code, or by interfering with its normal operation. We may suspend access to the website at any time.
The SUSHI SECRETS INC. name, the counter cross section design on our pages, and our written content may not be used in a way that suggests endorsement, partnership, or affiliation without our written permission. Requests for permission may be sent to booking@sushisecrets.buzz.
17. Third Party Services
Our booking and payment may rely on third party services. Those services are governed by their own terms and privacy policies, and we are not responsible for their acts or omissions. Where a third party service is used, we share only the information needed to complete the task, as described in our privacy policy.
If a third party service is unavailable, we may take your reservation by telephone at +17858189183 or by email at booking@sushisecrets.buzz so that a technical problem does not cost you a seat. We will confirm any booking made that way in writing.
18. Privacy
Our handling of personal information is described in our privacy policy, which forms part of these terms. In summary, we collect only the information we need to serve you, we do not sell it, and we protect it with reasonable safeguards. By accepting these terms, you confirm that you have had the opportunity to review our privacy policy. If you have not read it yet, please do so before you book, since it explains what happens to the details you give us when you reserve a seat.
19. Force Majeure
We are not responsible for a failure or delay caused by events beyond our reasonable control. Such events include natural disasters, severe weather, fire, illness affecting key staff, supply failures, labor disruptions, utility outages, and government action. If such an event prevents us from serving you, we will contact you and offer a reasonable alternative or a refund of any deposit for the affected service.
Force majeure does not excuse a payment obligation that you have already incurred for a service that was in fact provided. It applies to the performance of future services that cannot reasonably be delivered because of the event.
20. Governing Law And Disputes
These terms are governed by the laws of the State of California and the applicable laws of the United States, without regard to conflict of law rules. We ask that you contact us first at booking@sushisecrets.buzz so that we can try to resolve any concern informally and quickly. If a dispute cannot be resolved informally, it will be handled by the courts with jurisdiction over Berkeley, California, unless the law requires otherwise.
Each provision of these terms operates separately. If a court finds any provision unenforceable, the remaining provisions stay in full force. Our failure to enforce a provision on one occasion is not a waiver of our right to enforce it later.
21. Changes To These Terms
We may update these terms from time to time to reflect changes in our services or in the law. When we make a material change, we will update the date at the top of this page and, where appropriate, provide a more prominent notice. Changes apply to bookings made after the update takes effect. The terms that apply to your booking are the terms in force when you book.
We encourage you to review this page before each booking so that you always know the terms that will apply. If you do not agree with an updated version, you may choose not to make a new booking, and your rights under a prior booking remain as they were.
